Terms of Service

1. Introduction & Acceptance

These Terms constitute a legally binding agreement between you and ANIME POCKY LTD. They apply to all visitors, users, and other parties who access or use the Service.

We may update these Terms from time to time as described in Section 16. The most current version, with its effective date, will always be available on this page.

2. Eligibility & Account

The Service is intended for users aged 18 years or older. By using the Service you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into a binding agreement.

You may need to register an account to access certain features. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Keep your login credentials confidential and secure
• Be solely responsible for all activities under your account
• Notify us promptly of any unauthorized access at support@animepocky.com

We reserve the right to suspend or terminate accounts that violate these Terms, contain false information, or remain inactive for an extended period.

3. Service Description

The Service provides streaming access to short-form anime drama content. Features may include free episodes, premium content unlockable via virtual coins, optional subscription tiers, personalized recommendations, search, watchlists, and viewing history.

The availability of specific content, features, or pricing may vary by region and is subject to change without notice. We do not guarantee that any particular content will remain available indefinitely.

4. License to Use

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Service for your personal, non-commercial enjoyment.

You agree not to:

• Copy, download (except as expressly permitted), modify, distribute, sell, lease, or sublicense any part of the Service or its content
• Reverse engineer, decompile, disassemble, or attempt to extract the source code of the Service
• Use any robot, spider, scraper, or other automated means to access the Service
• Circumvent, disable, or otherwise interfere with security or paywall features
• Record, screen-capture, stream, or rebroadcast any content from the Service
• Use the Service to develop or train any competing product or model

5. User Conduct

You agree not to use the Service in any manner that:

• Violates any applicable law or regulation
• Infringes the intellectual property, privacy, publicity, or other rights of any party
• Transmits unsolicited or unauthorized advertising, promotional materials, spam, or chain letters
• Harasses, defames, threatens, or otherwise harms any other user
• Impersonates any person or entity, or misrepresents your affiliation with any person
• Uploads or transmits viruses, malware, or any other harmful code
• Attempts to gain unauthorized access to the Service, accounts, or computer systems
• Interferes with or disrupts the Service or its servers and networks

We reserve the right to investigate suspected violations and to take appropriate action, including legal action and reporting to law-enforcement authorities.

6. Virtual Coins & Purchases

The Service may use virtual coins or similar in-app currency ("Coins") to unlock premium episodes or features.

• Coins are a limited license to access digital content within the Service
• Coins have no monetary value, cannot be exchanged for cash, and are non-transferable
• Coins are non-refundable except where required by applicable law (see Section 8)
• Once Coins are used to unlock content, the transaction is final
• We may modify, replace, or discontinue Coins at any time
• Unused Coin balances may be forfeited upon account termination for cause

You may purchase Coin packages through approved payment methods. All purchases are processed by third-party payment providers and are subject to their terms.

7. Subscriptions & Auto-Renewal

If you purchase a subscription:

• Your subscription will automatically renew at the end of each billing period unless cancelled before the renewal date
• The renewal price equals the then-current rate for your subscription tier
• You must manage and cancel subscriptions through the platform where you subscribed (Apple App Store, Google Play, or directly through us)
• Cancellation takes effect at the end of the current billing period; you retain access until then
• We do not provide partial refunds for unused subscription time except where required by law

You are responsible for understanding the renewal terms displayed at the time of purchase.

8. Refund Policy

All purchases of Coins, subscriptions, and digital content are final and non-refundable once delivered or consumed, except as expressly required by applicable law.

For UK and EU consumers: Under the UK Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 and equivalent EU consumer protection laws, you have a 14-day right to cancel certain online purchases. However, this right does not apply to digital content where supply has begun with your prior express consent and acknowledgement that you thereby lose your cancellation right. By purchasing and starting to use Coins, premium content, or a subscription, you expressly consent to immediate supply and waive your 14-day cancellation right.

If you believe you are entitled to a refund under applicable law, contact legal@animepocky.com with your account email and order details.

9. Intellectual Property

All content, features, and functionality of the Service — including text, graphics, logos, images, audio, video, software, and the selection and arrangement thereof — are the exclusive property of ANIME POCKY LTD, our licensors, or other rights holders, and are protected by copyright, trademark, and other intellectual property laws of the United Kingdom and other jurisdictions.

The "AnimePocky" name, logo, and related marks are trademarks of ANIME POCKY LTD. You may not use these marks without our prior written permission.

Nothing in these Terms grants you any right, title, or interest in the Service or its content other than the limited license described in Section 4.

10. Third-Party Services

The Service integrates with or relies on third-party services, which may include:

• Payment processors (e.g., Stripe, Apple App Store, Google Play) for payment handling
• Video content delivery networks for streaming
• Authentication providers for account login
• Email service providers for transactional and notification emails
• Error monitoring and analytics tools for service reliability and product improvement
• Search infrastructure for content discovery

Your use of third-party services is governed by their respective terms and privacy policies. We are not responsible for the practices, content, or availability of any third-party service.

11. Notice & Takedown (Intellectual Property Infringement)

If you believe that content available through the Service infringes your copyright or other intellectual property rights, please send a written notice to legal@animepocky.com containing:

1. Your contact information (name, address, telephone, email)
2. A description of the copyrighted work or other right you claim has been infringed
3. The URL or specific location of the allegedly infringing content
4. A statement that you have a good-faith belief that the use is not authorized by the rights holder, its agent, or the law
5. A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the rights holder or authorized to act on their behalf
6. Your physical or electronic signature

We will review valid notices and take appropriate action, which may include removing the content and notifying the user who provided it. Repeat infringers may have their accounts terminated.

12. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, TO THE MAXIMUM EXTENT PERMITTED BY LAW. WE EXPRESSLY DISCLAIM ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.

We do not warrant that the Service will be uninterrupted, error-free, secure, or free of viruses or other harmful components, nor that any defects will be corrected.

Nothing in these Terms excludes or limits our liability for: (a) death or personal injury caused by our negligence; (b) fraud or fraudulent misrepresentation; or (c) any other liability that cannot be excluded or limited under applicable law.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL ANIME POCKY LTD, ITS DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM OR RELATING TO YOUR USE OF OR INABILITY TO USE THE SERVICE.

OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (a) THE AMOUNT YOU PAID TO US IN THE TWELVE MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (b) GBP £50.

14. Indemnification

You agree to indemnify, defend, and hold harmless ANIME POCKY LTD, its directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or relating to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any rights of any third party; or (d) any content you submit to or through the Service, where applicable.

15. Termination & Suspension

We may suspend or terminate your access to the Service at any time, with or without notice, for any reason, including breach of these Terms or prolonged inactivity.

You may stop using the Service and request account deletion at any time by contacting support@animepocky.com or using in-app account deletion features (where available).

Upon termination:

• Your right to access the Service ceases immediately
• Unused Coins may be forfeited
• Sections that by their nature should survive termination — including those covering intellectual property, disclaimers, liability limits, indemnification, and governing law — will survive

16. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by:

• Posting the updated Terms on our website or in-app, with a new effective date
• Sending notice to your registered email address
• Providing reasonable advance notice (typically 30 days) before changes take effect

Continued use of the Service after the effective date of updated Terms constitutes acceptance. If you do not agree to the changes, you must stop using the Service before the effective date.

17. Governing Law & Jurisdiction

These Terms and any dispute arising from or relating to them or the Service are governed by and construed in accordance with the laws of England and Wales, without regard to its conflict-of-laws principles.

You agree that the courts of England and Wales shall have exclusive jurisdiction to resolve any disputes, except that consumers domiciled in the United Kingdom or European Union retain the right to bring proceedings in their local courts where required by mandatory consumer protection law.

18. Miscellaneous & Contact

Severability. If any provision of these Terms is held invalid or unenforceable, the remaining provisions will continue in full force and effect.

Entire Agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the Service and supersede any prior agreements.

Assignment. You may not assign or transfer these Terms or your account without our prior written consent. We may assign these Terms freely.

No Waiver. Our failure to enforce any provision of these Terms is not a waiver of our right to do so later.
